As the Supreme Court of India prepares for transition in leadership, Justice B.R.Gavai who will be first Buddhist Chief Justice of India , has made a powerful statement : “The Supreme Court can’t be aloof when country is in danger ”. This declaration underlines the judiciary role in safeguarding democracy , protecting constitutional values .
A Powerful message ahead of Leadership Transition
Justice Gavai father converted into Buddhist in 1956 during the movement initiated by Babasaheb Ambedkar , following this entire family also adopted . Justice Gavai will be the second Chief Justice of India from the scheduled caste is set to become 51st Chief Justice of India .
He made these remarks in a public interaction to make a clear statement regarding “judiciary role which is not just to give judgements but also to protect the Constitution and spirit.” He remarked against the statement of BJP leader Nishikant Dubey regarding the Waqf hearing, claiming that , ‘CJI Sanjiv Khanna will be responsible for civil wars in India.’ that when country us pained after terrific pahalgam attack we can’t be aloof , Justice Sanjiv khanna was out of country still he held a meeting and passed resolution condemning the terror attack .
Judicial responsibility in time of crisis
Justice Gavai firmly stated the importance of the Supreme Court in protecting the constitution and democracy. Since India become independent the court has made crucial key decisions such as giving landmark judgement on Keshavananda Bharti case . Recently , the court has also made important rulings on political issues .
What justice Gavai is saying is the court has responsibility to take action when democratic values under threat . Especially when the country is at a crucial stage because few people feel that the courts are not doing enough in political powerful cases .

Justice Gavai at the post of Chief Justice of India is historic in itself . His elevation is not just a personal milestone but also a symbol of inclusivity in Indian Judiciary. He is known for his balanced approach and constitutional understanding , Justice Gavai have given several important judgements during his tenure however his tenure will remain for 6 months 9 days until his retirement. He is well suited for the post as the senior most judge in Supreme Court .
